To qualify for residency in Texas by owning and operating a business, the LLC's primary place of business must be a Texas address that is USPS deliverable. You can check the deliverability of the address by using the provided link. The address can be a dorm, home, or commercial location.
Please Note: Check that it's USPS deliverable. If it's not, you should use your PMB.
The address you enter will be used for three things:
Member Address: Mailing address for the governing authority (members/managers)
Business Address: For your franchise tax account. Correspondances from the Comptroller of Public Accounts are sent to the business mailing address.
Registered Agent Address: Service of process and any notifications or correspondences sent from the Secretary of State (this may not be a PO Box)
The address you enter will be publicly available on the Texas Secretary of State's website.
Common Questions
Can I use a family member's address?
Yes
If you do not live there though, you will need to obtain Proof of Address for when we set up your bank account. Main point--obtaining this Proof takes 5 minutes, is free, and easy.
Can I use my dorm address?
Yes
I'm moving next year, is this an issue?
It is very easy to update the Business Mailing Address and the Registered Agent Address ($15 filing fee). Changing the Management Address is more cumbersome, but still doable ($150 filing fee). From a residency perspective, updating or failing to update the address has no impact
The specific time frame for updating your LLC's address with the Texas Secretary of State is not specified in the Texas Business Organizations Code. However, it's advisable to do it as soon as possible after the change of address.
Can I use a PMB for the business address?
Yes; however, you will need a different address for the registered agent (they do not allow PMBs).
Why isn't my address showing up in the USPS database?
This is most likely because the address uses a PMB.
