Bottom line: Worth pursuing with planning
Winnable, but you will need to prove financial independence and keep tight documentation for the whole qualifying period. 13 KAR 2:045 Section 4 creates six rebuttable presumptions of nonresidency, including graduating from an out-of-state high school within five years, moving to Kentucky primarily to enroll, and moving to Kentucky and enrolling more than half time within twelve months, each overcome only by a preponderance of evidence. Under Section 10, a Kentucky driver's license, vehicle registration, voter registration and a 12-month lease carry only 'limited probative value.' The controlling rule is 13 KAR 2:045 (Determination of residency status for admission and tuition assessment purposes).

Who can qualify
If you are independent
An 'independent person' is one who demonstrates financial independence from parents or persons other than a spouse and meets the Section 5 criteria: tax dependency status on the prior year's federal and state returns, and independent earnings or resources sufficient for sustenance. A student enrolling immediately after high school graduation 'shall be presumed to be a dependent person unless the contrary is evident.'
If your parents claim you
A dependent student's domicile follows the parents; if the parents are divorced or separated, residency is established if either parent is a Kentucky resident, and if the parents later move out of state the dependent retains Kentucky resident status while continuously enrolled at the current degree level.
How to establish residency
- Live in Kentucky for 12 continuous months. Keep one fixed address, and keep proof of it for the whole period.
- Show intent to stay. These are the acts this state looks for:
- acceptance of or transfer into full-time employment in Kentucky (substantial probative value)
- twelve months of continuous physical presence in Kentucky in a nonstudent status (substantial)
- filing a Kentucky resident income tax return or having Kentucky taxes withheld (substantial)
- one year of full-time employment in Kentucky (substantial)
- abandonment of a former domicile and establishment of a Kentucky residence (substantial)
- Kentucky professional licensing or certification (substantial)
- ownership of real property used as a residence and payment of real property tax (substantial)
- marriage to an independent Kentucky resident (substantial)
- Kentucky driver's license (limited probative value)
- Kentucky vehicle registration (limited)
- Kentucky voter registration (limited)
- twelve-month noncollegiate housing lease (limited)
- Document your finances. Be ready to prove how you support yourself and that nobody out of state claims you as a dependent.
- Cut ties to your old state. Surrender the old license, cancel the old voter registration, and move your vehicle registration.
- Petition your university. File the reclassification application with the registrar or residency office before their deadline.

Deadlines
The University of Kentucky residency application and all documentation are due no later than thirty calendar days after the start of the semester, received or postmarked by 4:30 p.m. on the deadline (Fall 2026: September 23; Spring 2027: February 10; Summer 2026: June 17). The application must be notarized, and incomplete applications are not accepted.
Shortcuts and exceptions
These groups may qualify faster, or right away:
- active-duty service members with a Kentucky duty station for 30+ days, plus spouses and dependents
- members with Kentucky domicile at induction, during active service or within 6 months of discharge
- Kentucky National Guard members on active duty 30+ days, plus spouses and dependents
- beneficiaries of the Post-9/11 Veterans Educational Assistance Act of 2008 (38 U.S.C. 3301-3325)
- beneficiaries of a Kentucky Educational Savings Plan Trust meeting KRS 164A.330(6)
- Kentucky high school graduates who are undocumented, hold a restricted visa, or are dependents of restricted-visa holders
- holders of unrestricted nonimmigrant visa categories (A, E, G, H-1, H-4 with H-1 sponsor, I, K, L, N, R) and permanent residents/refugees
- SREB Academic Common Market participants
- CPE-approved border tuition reciprocity agreements with Ohio, Indiana and West Virginia (participating institutions only)
The detail most people miss
Kentucky's border tuition reciprocity agreements, which give discounted rates to students from bordering Ohio, Indiana and West Virginia counties, are approved by the Council on Postsecondary Education only at Morehead State, Murray State, Northern Kentucky University, the University of Louisville, Western Kentucky University and the KCTCS colleges. The University of Kentucky is not a participant, so the state's best-known out-of-state discount does not exist at the flagship. Separately, 13 KAR 2:045 Section 10 warns that while a Kentucky driver's license and voter registration carry only limited weight in your favor, their ABSENCE carries significant weight against you.
Common mistakes
- Starting late. The clock runs before enrollment, so a plan that begins in your first semester is already behind.
- Keeping old-state ties. An out-of-state license, voter registration, or car tag can sink an otherwise strong case.
- Thin documentation. Reviewers decide on paper. If you cannot prove it, it did not happen.
- Assuming your school reads the rule loosely. Campuses vary in how strictly they apply the same statute.
