Bottom line: Worth pursuing with planning
Winnable, but you will need to prove financial independence and keep tight documentation for the whole qualifying period. SUNY policy states you do not acquire domicile by being physically present in New York to attend college, and campuses treat residence halls as temporary housing that cannot support a domicile claim. Dependent students are judged entirely on the parents' principal home, so a dependent undergraduate living in a dorm cannot build a qualifying record. The controlling rule is SUNY Policy 7810, Residency, Establishment of for Tuition Purposes.

Who can qualify
If you are independent
There is no explicit dollar self-support test, but the dependent or independent determination drives everything. Dependent students must submit their parents' license, tax returns, housing proof, and utility statements; independent students must supply the same documents in their own name, and nothing may be in another person's name.
If your parents claim you
A dependent student is classified on the parents' principal home, so they qualify if the parents have kept New York domicile for the 12 months before the term. Legal guardianship documents must come from a New York court and be dated 12 or more months before the term.
How to establish residency
- Live in New York for 12 continuous months. Keep one fixed address, and keep proof of it for the whole period.
- Show intent to stay. These are the acts this state looks for:
- New York driver's license or non-driver ID card
- New York vehicle registration
- New York voter registration
- New York and federal income tax returns filed as a New York resident
- New York property ownership or a residential lease
- Employment within New York
- Utility bills in your name at a New York address
- Document your finances. Be ready to prove how you support yourself and that nobody out of state claims you as a dependent.
- Cut ties to your old state. Surrender the old license, cancel the old voter registration, and move your vehicle registration.
- Petition your university. File the reclassification application with the registrar or residency office before their deadline.
Documents to collect
- Application for New York State Resident Status for Tuition Billing Purposes
- Proof of citizenship or permanent residency
- New York driver's license or ID card, since interim or out-of-state versions are not accepted
- Signed federal and New York State tax returns for the prior year
- Proof of housing covering 12 consecutive months, such as a deed, signed lease, or notarized landlord letter
- Two utility statements, one from 12 months before the term and one from the current month
- One additional document such as a vehicle registration, voter card, New York W-2, or jury duty proof
Deadlines
At Buffalo, applications are due June 1 for summer, September 1 for fall, January 2 for winter session, and February 1 for spring. Residency issues should be resolved by the first day of classes.
Shortcuts and exceptions
These groups may qualify faster, or right away:
- Nonresidents who completed their junior and senior years at an approved New York high school and apply within five years of graduating, and New York GED holders
- Active-duty service members stationed in New York, their spouses, and dependents
- Dependents of service members stationed elsewhere whose home of record is New York
- Veterans and dependents of veterans using GI Bill benefits
- Certain non-immigrant visa holders may establish New York domicile
- Graduate assistants with a tuition remission form
The detail most people miss
Where you sleep decides the case. Buffalo will not count a campus residence hall toward New York domicile because dorms are treated as temporary housing, but it does accept a lease in a university-affiliated apartment complex, so two students on the same campus can get opposite outcomes based purely on housing assignment. Documents must also bracket the full year: one utility statement dated 12 months before the term and one from the current month, so you cannot retroactively build the record in the spring.
Common mistakes
- Starting late. The clock runs before enrollment, so a plan that begins in your first semester is already behind.
- Keeping old-state ties. An out-of-state license, voter registration, or car tag can sink an otherwise strong case.
- Thin documentation. Reviewers decide on paper. If you cannot prove it, it did not happen.
- Assuming your school reads the rule loosely. Campuses vary in how strictly they apply the same statute.
